New European Data Protection Act – what changes?
As we know, the European Data Protection Regulation has already entered into force, although it will be obligatorily applicable two years after its entry into force, that is to say on 25 May 2018.
This Regulation aims to give more power to the interested parties over their personal data, both in social networks, smartphones, online banking, etc., so that they will have greater control over their data.
However, this Regulation does not come alone.
In Spain, a draft of a new Organic Law on Data Protection is being processed, which adjusts our legislation to this new Regulation, so we will have to be vigilant in the coming months following the approval of the new law and what it implies.
Don’t know what these changes mean for your company?
The RGPD understands that acting only after the infringement has already taken place is not sufficient as a strategy, because such an infringement can cause damage to data subjects that can be very difficult to compensate or repair.
To this end, all organisations that process data must carry out a risk analysis of their processing in order to establish what measures they should apply and how to do so.
These analyses can be simple procedures in entities that only carry out a few elementary treatments that do not involve, for example, specially protected data, or more complex work in entities that carry out many treatments, that affect a large number of people or that, due to their characteristics, require a careful assessment of their risks.
